These Terms of Service ("Terms") are a legal agreement between you and PeekMii OÜ ("PeekMii", "we", "us", "our"). They govern your access to and use of the PeekMii website, mobile experiences, and related services (collectively, the "Service"). PeekMii is a creator subscription platform that enables verified creators to publish content and enables fans to purchase subscriptions and other digital access. By creating an account, visiting, browsing, or otherwise using the Service, you agree to these Terms. If you do not agree, you must not use the Service.

  • The Service is for adults only. You must be at least 18 and the age of majority in your jurisdiction.
  • You are responsible for complying with your local laws when accessing or using the Service.
  • Disputes are governed by Estonian law and, where required, consumer rights remain unaffected.

Important: These Terms include limitations of liability, dispute procedures, and rules for content, payments, and safety.

1. Definitions

In these Terms, "Creator" means a user who applies for and is approved to publish content and receive payouts. "Fan" means a user who purchases access, subscriptions, or other digital content from a Creator through the Service. "User Content" means any text, images, videos, audio, messages, or other materials uploaded or shared by users. "Transaction" means any subscription, tip, pay-per-view purchase, or similar digital purchase facilitated by the Service. Defined terms apply whether used in singular or plural.

2. Eligibility (18+), Account Types

The Service is intended for adults only. You must be at least 18 years old and have reached the age of majority where you live. You may not use the Service if you are prohibited by applicable law or if you have been permanently banned. You may register as a Fan or apply as a Creator; additional requirements apply to Creators. We may request information to confirm eligibility and may refuse access if we cannot verify your eligibility.

  • Fans: may browse and purchase access as allowed by the Service.
  • Creators: must complete verification and comply with creator-specific rules and payout requirements.

3. Service Overview and Scope

PeekMii provides a platform that enables creators to publish content and set prices, and enables fans to pay for access. PeekMii is a facilitator of platform functionality and payment processing, but does not become a party to transactions between users. Creators are solely responsible for their content and for delivering access as described. We may add, remove, or modify features to improve the Service, comply with law, or reduce risk.

4. Account Registration and Security

You must provide accurate information when creating an account and keep it updated. You are responsible for safeguarding your login credentials and for all activity under your account. You must promptly notify us if you suspect unauthorized access. You may not sell, rent, or transfer your account, and you may not use another person's account without permission. We may require additional verification steps if we detect suspicious activity.

5. Creator Verification (KYC) and Identity Checks

To protect users, meet payment processor requirements, and comply with law, Creators must complete identity verification (KYC). KYC may include government-issued ID verification, selfie matching, and liveness checks to confirm that you are a real person. We may re-verify Creators periodically or if risk signals are detected. If verification fails or information is inconsistent, we may deny or revoke Creator status.

  • Recommended approach: Government ID + selfie + liveness (best balance of safety and fraud prevention).
  • We store only what is necessary for compliance and operational security.

6. Biometric Data Use (KYC Only)

If identity verification uses biometric signals (such as facial geometry extracted from a selfie or liveness video), it is used strictly to complete verification and prevent fraud. We do not use biometric data to market to you, profile you for advertising, or sell it to third parties. Biometric data, if collected, is retained only as long as required for verification, compliance, and security audits, and then deleted or irreversibly anonymized where feasible. We apply access controls and limit internal access to authorized personnel and vetted vendors.

7. Co-Created Content and Consent

Creators may upload content featuring other adults only if every identifiable participant is an adult and has consented. You must maintain written records of consent and age verification for each participant depicted, and provide them to us upon request. If content includes another Creator, you may be required to tag them or provide additional verification documentation. We may withhold distribution of co-created content until documentation is confirmed.

  • Minimum recordkeeping: copies of IDs (age check) and signed consent for distribution on PeekMii.
  • You are responsible for revenue splits and agreements with co-creators.

8. AI Creators and Synthetic Media Rules

PeekMii may allow creators whose brand involves AI-assisted or synthetic content, subject to strict transparency and safety rules. If you publish AI-generated or heavily AI-altered media that appears photorealistic, you must clearly label it as AI-generated or AI-altered. You may not use AI to impersonate a real person without their written consent, and you may not create or distribute non-consensual deepfakes. AI creators are still required to complete KYC if they receive payouts, because payouts require a real legal person or legal entity.

  • Allowed: clearly labeled AI content that does not depict minors, non-consensual acts, or impersonation.
  • Not allowed: deepfakes of real individuals without consent; any underage or CSAM-related content; deceptive identity claims.

9. Community Guidelines and Prohibited Content

You must not upload, share, or request content that is illegal, non-consensual, exploitative, or otherwise unsafe. We prohibit child sexual abuse material (CSAM) and will report suspected CSAM to relevant authorities as required. We prohibit sex trafficking, solicitation for in-person sexual services, and facilitation of prostitution. We also prohibit content that depicts or promotes extreme violence, coercion, non-consensual sexual activity, or illegal conduct. We may remove content and suspend accounts that violate these rules.

  • No minors: any depiction or suggestion of minors in sexual contexts is strictly prohibited.
  • No non-consensual content: including revenge porn, covert recordings, or content shared without permission.
  • No illegal services: including solicitation for in-person sexual activity or trafficking.

10. Intellectual Property and DMCA

PeekMii respects intellectual property rights. You may not upload content that infringes copyrights, trademarks, or other rights. We respond to properly submitted copyright notices under the Digital Millennium Copyright Act (DMCA) and analogous laws. If you believe content infringes your rights, you may submit a notice to our designated contact (to be listed in the DMCA Policy). Repeat infringers may have their accounts terminated.

11. User Content License

You retain ownership of your User Content, subject to the licenses you grant in these Terms. By posting User Content, you grant PeekMii a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute your content solely to operate and improve the Service. This includes creating technical copies, thumbnails, and previews, and delivering content to authorized viewers. We do not sell your paywalled content or grant it to others outside the Service without your permission.

12. Content Access, Downloads, and Restrictions

Fans may access purchased content only through the Service and only for personal, non-commercial use. You may not copy, record, redistribute, resell, or publicly display Creator content unless explicitly permitted by the Creator in writing and allowed by law. We may use technical measures to deter unauthorized recording and redistribution. Violations may result in account suspension and legal action.

13. Messaging, Safety, and Abuse Reporting

The Service may include direct messaging and community interaction features. You must not harass, threaten, extort, or send unsolicited abusive content to other users. You may report violations using in-product tools or by contacting support. We may preserve records and cooperate with lawful requests where required.

  • Report CSAM or safety emergencies immediately to support and relevant authorities.
  • Use blocking tools to prevent unwanted contact; blocking may affect access to paid content as described in the Service.

14. Moderation: Post-Moderation + Complaints Handling

PeekMii operates a post-moderation model: content may be published first and then reviewed through automated signals, user reports, and periodic audits. We review reports and take action including removal, age-gating, warnings, demonetization, or account suspension. We aim to respond to properly submitted complaints within 7 business days, depending on complexity and volume. We may request additional information from the reporting party or the user who posted the content.

  • Pre-moderation means content is reviewed before publication; post-moderation means review occurs after publication.
  • We may accelerate review for high-risk categories (e.g., suspected CSAM, non-consensual content, threats).

15. Payments, Billing, and Wallets (if applicable)

To purchase subscriptions or other paid access, you must provide a valid payment method supported by our payment providers. Payment processing is handled by third-party payment providers ([PAYMENT PROVIDER]). If wallet functionality is enabled, wallet balances may be non-refundable except as required by law or stated in our Refund Policy. You authorize us to charge your payment method for recurring subscriptions until you cancel.

16. Fees and Platform Commission

Creators receive earnings net of platform fees, payment processing costs, taxes (if applicable), and adjustments for chargebacks or fraud. Our standard platform commission is 20% of amounts paid by Fans to Creators via the Service, unless a different rate is communicated in writing for a specific program. We may modify fees with notice, and changes apply prospectively. We may introduce optional paid features for Creators, which will be clearly disclosed.

17. Promotional Programs (0% Fees for Early Creators)

From time to time, we may run promotional programs such as a 0% platform fee period for selected Creators (the "Promotion"). Promotions are marketing initiatives and may have eligibility criteria, start and end dates, and limitations. Unless explicitly stated otherwise, Promotions do not waive third-party payment processing fees, taxes, or deductions related to chargebacks and fraud. We may modify or end a Promotion prospectively, but will not retroactively change fees already applied to completed transactions.

18. Payouts to Creators

Creators must provide accurate payout details and may be required to complete additional verification for payouts. Payout schedules depend on the payment provider's settlement timelines and risk controls. We may hold payouts temporarily for security reviews, suspected fraud, chargeback spikes, or compliance checks. Creators are responsible for ensuring their payout accounts are valid and accessible.

19. Taxes

You are responsible for your own taxes arising from your use of the Service. Creators are responsible for reporting and paying income taxes on earnings. We may collect certain tax information where required by law or by payment providers. If required, we may apply withholding or collect indirect taxes (such as VAT) depending on jurisdiction and product classification.

20. Chargebacks and Fraud Prevention

If a Fan initiates a chargeback, reversal, or payment dispute, we may deduct the disputed amount and related fees from Creator earnings associated with that transaction. We may investigate transaction disputes and may request information from Creators. We use risk controls to reduce fraud, including monitoring unusual activity and enforcing account verification. Fraudulent activity may result in immediate suspension and referral to law enforcement where appropriate.

21. Refund Policy

Digital content purchases are generally final and non-refundable unless required by applicable consumer protection law. We may issue refunds at our discretion in limited cases, such as verified billing errors or unauthorized transactions. Refund eligibility may vary by jurisdiction and payment method. To request a refund, you must contact support with transaction details within a reasonable time.

22. Third-Party Services and Links

The Service may contain links to third-party websites or integrate third-party tools. We do not control third-party services and are not responsible for their content, policies, or availability. Your use of third-party services is at your own risk and subject to their terms. If a third-party provider is required for payments, verification, or analytics, we may change providers as needed.

23. Privacy and Data Protection

Our Privacy Policy explains how we collect, use, and share personal data. We process personal data for account administration, security, compliance, payments, and product improvement. We do not sell personal data as a standalone product. Where applicable, you may have rights to access, delete, or correct your data, subject to legal retention requirements.

24. Security and Availability

We implement reasonable technical and organizational measures to protect the Service, but no system is perfectly secure. You are responsible for protecting your devices and accounts. We may perform maintenance, updates, or emergency fixes that may temporarily affect availability. We do not guarantee uninterrupted access, but we aim to maintain reliable service.

25. Termination, Suspension, and Enforcement

You may stop using the Service at any time; account deactivation options may be available in settings. We may suspend or terminate accounts for violations of these Terms, legal compliance needs, fraud risks, or safety concerns. We may remove content or restrict features (such as messaging or payouts) to mitigate risk. Where feasible, we provide notice, but we may act without notice for serious violations.

  • Severe violations may include CSAM, trafficking-related activity, non-consensual content, and credible threats.
  • Termination may result in loss of access to content and forfeiture of promotional eligibility.

26. Notices and Electronic Communications

You consent to receive communications electronically, including emails and in-product notices. Operational notices may include security alerts, billing confirmations, and policy updates. Marketing communications may be sent only where permitted and you may opt out where required. Notices are considered delivered when sent to the most recent contact details you provided.

27. Disclaimers

The Service is provided on an "as is" and "as available" basis to the maximum extent permitted by law. We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement to the extent allowed. We do not guarantee that any Creator will earn any specific amount, that any content will remain available, or that all content is accurate. User Content is created by users, not by PeekMii, and we do not endorse user statements.

28. Limitation of Liability

To the maximum extent permitted by law, PeekMii will not be liable for indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim related to the Service will not exceed the greater of (a) 100 EUR or (b) the amount you paid us (if any) in the 12 months before the claim. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. Nothing limits liability for matters that cannot be limited under law.

29. Indemnification

You agree to indemnify and hold harmless PeekMii, its officers, directors, employees, and contractors from claims arising out of your use of the Service, your User Content, or your violation of these Terms. This includes reasonable legal fees and costs. We will notify you of claims where legally required and will cooperate in your defense. You may not settle any claim that imposes obligations on PeekMii without our written consent.

30. Governing Law and Dispute Resolution

These Terms are governed by the laws of Estonia, without regard to conflict-of-law rules. If you are a consumer, mandatory consumer protections in your jurisdiction may still apply. Before filing a formal claim, you agree to contact us to attempt informal resolution. Unless mandatory law provides otherwise, courts located in Tallinn, Estonia will have jurisdiction over disputes.

31. Changes to the Service and These Terms

We may update the Service and these Terms to reflect legal, security, operational, or product changes. When we make material changes, we will update the "Last Updated" date and may provide additional notice. Changes apply prospectively from the effective date. Your continued use after the effective date means you accept the updated Terms.

32. Miscellaneous (Severability, Assignment, Entire Agreement)

If any provision is held unenforceable, the remaining provisions will remain in effect, and the unenforceable portion will be modified to the minimum extent necessary. You may not assign your rights under these Terms without our written consent; we may assign our rights as part of a corporate transaction. These Terms, together with referenced policies (Privacy Policy, DMCA Policy, and any published rules), constitute the entire agreement regarding the Service. Headings are for convenience only and do not affect interpretation.
